The Gauteng High Court in Pretoria has gagged activist Ngizwe Mchunu, prohibiting him from issuing further defamatory remarks regarding Julius Malema.
The urgent ruling follows two interviews conducted in late April 2026, during which Mchunu levelled a series of unsubstantiated criminal allegations against the Economic Freedom Fighters (EFF) leader.
The court heard that Mchunu accused Malema of corruption and financial ties to illegal syndicates, specifically claiming he had received $60 million from Nigerian drug dealers.
Mchunu further alleged that Malema was “willing to lose everything” to protect illegal immigrants and referred to the politician as a “political devil” and a “dead snake.”
He also repeated long-standing allegations regarding the VBS Mutual Bank scandal and On-Point Engineering.
Judge Khumalo ruled that these statements were unequivocally defamatory. The interim interdict strictly forbids Mchunu from repeating these allegations, whether explicitly or by implication, pending a final determination on damages.
The court expressed its displeasure by awarding punitive costs against Mchunu, requiring him to cover the expenses of Malema’s legal team, including two counsel.
Mchunu is mandated to appear in court on 19 May 2026 to show cause why the current order should not be made final.
This legal setback for Mchunu occurs amidst a period of heightened friction between his “Amabhinca Nation” movement and the EFF’s stance on pan-Africanism and immigration.
