  • The next step would be the confirmation of charges under Article 61 of the Rome Statute, where the PTC will decide whether there are “substantial grounds to believe” that Duterte committed the alleged crimes. This decision is expected on April 28, or 60 days after the confirmation hearing.
  • A confirmation of jurisdiction would also uphold the validity of Duterte’s ongoing detention under ICC rules.
  • However, if the Appeals Chamber overturns the PTC decision due to errors of fact, law, or procedure, it may either terminate the proceedings or remand the case to the PTC for further review under Article 83 of the Rome Statute and Rule 158 of the ICC Rules of Procedure and Evidence.
