Drama unfolded in the Brakpan Magistrate’s Court when Matiphandile “Andy” Sotheni, the man accused of murdering “Witness D” Marius van der Merwe, abruptly rejected his legal counsel.

Sotheni, 41, is a former member of the SAPS Special Task Force.
He stands accused of the December 2025 assassination of Van der Merwe, who was shot dead outside his home.
The victim was a high-profile whistleblower who had recently testified at the Madlanga Commission regarding systemic corruption and political interference within South Africa’s justice system.
In open court, Sotheni claimed he had no prior acquaintance with his solicitor, Eric Bryer, asserting that Bryer was acting without his instruction.
While Bryer reportedly produced documentation confirming his appointment, he formally withdrew from the case, citing an irreparable breakdown in the attorney-client relationship.
The proceedings have been adjourned until May 2026. Sotheni remains in custody and continues to deny any involvement in the killing.
