The National Prosecuting Authority (NPA) confirmed on Monday that it will initiate criminal proceedings against those implicated in the Life Esidimeni tragedy.
This long-awaited decision follows the 2015–2016 crisis, during which at least 141 psychiatric patients died after being moved from licensed facilities to ill-equipped, unregistered NGOs.

For nearly ten years, the families of the victims have faced agonising delays.
The NPA attributed the slow progress to the case’s immense scale and a recent leadership transition; the decision required endorsement from both the retired National Director of Public Prosecutions (NDPP) and the newly appointed Advocate A. Mothibi.
Following a comprehensive briefing, Advocate Mothibi gave the final approval to proceed, acknowledging the public’s urgent need for resolution.
The decision stems from the findings of an inquest presided over by Judge Teffo, which concluded that systemic failures and criminal negligence within the Gauteng Department of Health directly caused the fatalities.
The NPA has determined there is sufficient evidence to secure convictions, with charges expected to include culpable homicide.
While specific court dates and the names of the accused are yet to be released, the move marks a definitive step towards legal closure for the bereaved families.
